Terms and Conditions

1. Rental Agreement

 

By renting equipment from Earth Movers Equipment Rental (“Company”), the renter (“Customer”) agrees to the following terms and conditions.

​

2. Rental Period

 

  • The rental period begins when the equipment is delivered and ends when it is returned in the same condition.

  • Late returns may incur additional charges.

​

3. Rental Fees & Payments

 

  • All rental fees must be paid in full before equipment delivery.

  • Additional charges may apply for excessive wear, damage, or late returns.

4. Equipment Use & Responsibility

 

  • The Customer agrees to use the equipment only for its intended purpose and in a safe manner.

  • The Customer assumes all responsibility for damage, loss, or theft during the rental period.

  • The Customer must operate the equipment in compliance with all local laws and safety regulations.

5. Maintenance & Repairs

 

  • The Customer is responsible for daily maintenance, including checking fluids and keeping the equipment clean.

  • Any damage or mechanical issues must be reported immediately.

  • Repairs due to misuse or negligence will be charged to the Customer.

6. Liability & Insurance

​

  • The Company is not responsible for any injuries, damages, or losses resulting from the use of the equipment.

  • The Customer is responsible for obtaining any necessary insurance coverage.

7. Return Conditions

 

  • The equipment must be returned clean and in working condition.

  • A cleaning fee of $75 will be charged if the equipment is returned in poor condition. This fee will be deducted from your security deposit.

  • A repair fee of $150 be charged if the equipment is returned in poor condition. This fee will be deducted from your security deposit.

  • The fuel tank must be full upon return, as it was when the machine was received. A refueling fee of $50 will be charged if the fuel tank is not full at the time of return. This fee will be deducted from your security deposit.

8. Cancellations & Refunds

 

  • Cancellations must be made at least 24 hours in advance for a full refund. Otherwise you will only receive half the amount you originally paid.

  • No refunds for early returns.

9. Indemnification

 

  • The Customer agrees to indemnify and hold harmless Earth Movers Equipment Rental from any claims, damages, or liabilities arising from the use of the equipment.

10. Governing Law

 

  • These terms and conditions are governed by the laws of the state in which the rental takes place.

By renting equipment from Earth Movers Equipment Rental, the Customer agrees to these terms and conditions.

About The Service

1. Rental Process

​

  • Reservation: Customers can book equipment by phone, email, or online. Availability is based on a first-come, first-served basis.

  • Delivery: Currently, we offer delivery only for our machines. The delivery and pick-up fee is $220 within 20 miles of our location. For each additional mile, there is a $2 charge.

  • Equipment Inspection: Before rental, all equipment is inspected and documented to ensure it is in proper working condition. Customers are encouraged to inspect the equipment upon receipt.

2. Payment Terms

  • Full payment is required before the rental period begins.

  • We accept major credit/debit cards.

  • A security deposit of $150 will be required and will be refunded upon the safe return of the equipment.

  • Additional charges may apply for late returns, damages, or excessive wear and tear.

3. Service Agreement & Responsibilities

​​

  • Customers are responsible for operating the equipment safely and only for its intended use.

  • Routine maintenance, such as checking fluids and cleaning, is required during the rental period.

  • Any issues, malfunctions, or damages must be reported immediately.

  • Repairs due to misuse or negligence will be charged to the customer.

4. Returns & Refunds

  • Equipment must be returned on time, clean, and in the same condition as received.

  • Late returns may result in additional fees.

  • A cleaning fee of $75 will be applied if equipment is returned dirty.

  • Refunds will not be issued for early returns.
